These Terms of Service apply to all purchases made through the website alexandreairian.com. The website is operated by Alexandre Airian, a sole trader based in France.

1. General

By placing an order with Alexandre Airian, you agree to these Terms of Service. Please read them carefully before making a purchase.

2. Custom Portraits and Commissions

Each portrait is created to order based on your photos, references, and instructions.

Because these are personalized, handmade artworks, custom commissions cannot be returned or refunded.

The 50% deposit is non-refundable.

I will do my best to meet your expectations. If you have concerns or questions, please contact me within 7 days of receiving your artwork.

Note: I specialize in portrait paintings, but can also create pet portraits, movie scenes, master copies, and human figures.

3. Prints, Drawings, and Ready-Made Artwork

All artworks other than commissions, including prints, drawings, and ready-made paintings, may be returned within 14 days of delivery, in accordance with European consumer law, provided they are returned in their original condition and packaging.

Return shipping costs are the responsibility of the customer.

Responsibility for the artwork transfers to the buyer upon delivery. I am not responsible for loss or damage occurring after delivery, except as required by law.

I am not responsible for changes in the artwork due to climate, humidity, moisture, mold, infestation, staining, warping, shrinkage, expansion, cracking, corrosion, or any other environmental or aging-related factors.

4. Payment

Commissions require a non-refundable 50% deposit.

The final payment must be completed before shipping.

Payments can be made using the methods offered on the website during checkout. For commissioned works, payment will be made via Wise or Paypal

5. Shipping

Shipping for custom commissions depends on the size of the painting and the location of the collector.

Shipping costs for prints, drawings, and ready-made artworks are calculated at checkout.

I’m not responsible for delays caused by customs, carriers, or incorrect shipping information.

6. Intellectual Property

All artworks and images on this website are the property of Alexandre Airian and are protected by copyright law.

You may not copy, reproduce, or use any images or videos from this website without written permission.

7. Liability

I’m not liable for any damages resulting from the use of products or this website.

If a product arrives damaged, please contact me within 3 days of delivery with photos so the issue can be resolved.

8. Changes to Terms

I reserve the right to update or modify these Terms of Service at any time.

Changes will be posted on the website, and continued use of the website constitutes acceptance of the updated terms.

9. Customs Duties and Import Taxes

International buyers are responsible for any customs duties, import taxes, or fees imposed by their country. These costs are not included in the purchase price or shipping fees.

10. Reproduction and Image Rights

I retain all reproduction rights to my artworks, including sold and commissioned paintings.

The purchase of an original artwork does not transfer copyright or reproduction rights to the buyer.

No artwork, image, or video from this website may be copied, reproduced, distributed, published, or used in any way without my prior written permission, whether for personal or commercial purposes.

This includes downloading images, taking screenshots, making prints, or reproducing the artwork in any digital or physical format.

11. Governing Law

These Terms of Service are governed by French law.

If a dispute arises, it will be handled in accordance with French law, without affecting any mandatory consumer rights provided by European regulations.
